A person who intentionally touches someone who is sixteen years of age or younger in a lewd and lascivious way, or forces them to touch the offender, is committing lewd and lascivious molestation.

A person eighteen years or older who commits and is guilty of lewd or lascivious molestation against someone less than twelve years of age is charged with a life felony.

Lewd and Lascivious Conduct

A person who intentionally touches another person under the age of sixteen in a lewd and lascivious way or solicits another person under the age of sixteen to engage in a lewd and lascivious act is guilty of committing lewd and lascivious conduct.

A person eighteen years of age or older who commits lewd and lascivious conduct is charged with a second degree felony. Any person younger than eighteen who commits lewd and lascivious conduct is charged with a third degree felony.

Lewd and Lascivious Exhibition

A person who intentionally masturbates, exposes his or her genitals in a lewd and lascivious way, or commits another sexual act that does not include physical or sexual contact or sadomasochistic abuse, sexual bestiality, or a simulation of a sexual activity around anyone younger than sixteen is committing lewd and lascivious exhibition.

A person eighteen years of age or older who commits lewd and lascivious exhibition is charged with a second degree felony. Any person younger than eighteen who commits lewd and lascivious exhibition is charged with a third degree felony. This does not include a mother breastfeeding her baby.
